services operated or made available by Turner’s Contracting Solutions Inc. (“Turner’s Contracting Solutions,”
“TCS,” “Company,” “we,” “us,” or “our”).
By accessing or using any TCS website, application, customer portal, online service, or digital feature, you
acknowledge that you have read, understood, and agree to these Terms.
If you do not agree with these Terms, you should not use the applicable website, application, or digital service.

TCS provides construction, remodeling, repair, renovation, project management, and related services.
Information displayed through our website or applications may describe our services, examples of prior work,
materials, products, processes, or potential project options.
Website and application information is provided for general informational purposes and does not, by itself,
constitute a binding proposal, estimate, contract, warranty, or guarantee of a particular result.

4. Project Agreements
If you hire TCS for construction or related services, the work will be governed by a separate written construction
agreement, proposal, estimate, scope of work, specifications, plans, change orders, warranty documents, and/or
other project documents applicable to your particular project.
A project-specific written agreement controls the terms of that project if there is any conflict between these Terms
and the project agreement.
These Terms are not intended to replace or modify a signed construction agreement unless the applicable project
agreement expressly states otherwise.
5. Estimates and Proposals
Any pricing, estimates, schedules, descriptions, photographs, examples, or other information provided through our
website or applications may be preliminary and may be subject to further review.
A final project price, scope of work, payment schedule, and completion schedule will be established in the
applicable written project agreement.
Conditions that cannot reasonably be discovered before work begins may require additional work, pricing, time, or
a written change order as provided in the applicable construction agreement.
6. Change Orders
Changes to an approved project scope should be documented through a written change order.
Unless otherwise agreed in writing, TCS is not responsible for work, materials, costs, delays, or representations
arising from unauthorized changes or instructions given to employees, subcontractors, suppliers, or other persons
without proper authority from TCS management.
Project-specific change-order requirements are governed by the applicable construction agreement.
7. Payments
Where online payment services are made available, you agree to provide accurate payment and billing information
and to pay all amounts when due under the applicable project agreement.
Electronic payment processing may be provided by third-party payment processors. Additional terms imposed by
the applicable payment processor may apply.
TCS reserves all rights and remedies available under the applicable project agreement and applicable law for
unpaid balances.
8. Electronic Communications
By using our online services or providing your contact information, you consent to receive communications from
TCS relating to your inquiry, project, account, scheduling, payments, documents, change orders, warranties, and
other business matters.
Electronic communications may include email, text messages, application notifications, electronic documents, and
other digital communications.
You are responsible for maintaining accurate contact information and for reviewing communications sent to you.

Where permitted by law, TCS may use electronic signatures, electronic approvals, electronic records, electronic
change orders, and electronic delivery of contracts and other project documents.
An electronic signature or approval may have the same effect as a handwritten signature to the extent permitted by
applicable law.
10. User Responsibilities
You agree to:
Provide accurate information when communicating with TCS;
Provide accurate project information, dimensions, plans, specifications, selections, and other information
reasonably necessary for estimating or performing the work;
Maintain appropriate access to the property when required;
Make required payments when due;
Review project documents and communications in a timely manner;
Avoid giving unauthorized instructions to TCS employees, subcontractors, or suppliers;
Notify TCS promptly of material changes or conditions affecting the project.
Customer responsibilities relating to an actual construction project are governed primarily by the applicable
construction agreement.
11. Website and Application Content
Unless otherwise stated, content appearing on TCS websites and applications, including text, photographs,
graphics, logos, designs, videos, documents, and other materials, is owned by or licensed to TCS and may not be
copied, reproduced, modified, distributed, or commercially exploited without written permission.
12. Project Photographs and Media
TCS may photograph or record projects for documentation, quality-control, portfolio, promotional, advertising, and
educational purposes to the extent permitted by the applicable project agreement and applicable law.
Project-specific media rights may be governed by the construction agreement.
TCS will not intentionally disclose confidential customer information through marketing materials.
13. Third-Party Products and Services
TCS may reference or use products, materials, manufacturers, suppliers, payment processors, software providers,
scheduling services, or other third-party services.
TCS does not control third-party websites or services and is not responsible for their independent terms, privacy
policies, availability, or performance.
Manufacturer warranties, when applicable, may be separate from any warranty provided by TCS.
14. No Guarantee of Website Availability
TCS does not guarantee that its websites, applications, portals, or online services will always be available,
uninterrupted, secure, or error-free.
Services may occasionally be unavailable because of maintenance, technical problems, third-party services,
internet interruptions, or circumstances beyond TCS's reasonable control.

15. Prohibited Uses
You may not use TCS websites or applications to:
Violate applicable law;
Submit fraudulent or misleading information;
Attempt to gain unauthorized access to systems or accounts;
Interfere with the operation or security of our systems;
Upload malicious software;
Impersonate another person or business;
Use our content or systems for unauthorized commercial purposes;
Interfere with another customer's use of our services.
16. Privacy
Information submitted through our websites and applications may be collected and used in accordance with TCS's
Privacy Policy.
The Privacy Policy should be reviewed separately and incorporated into the Company's online legal framework.
17. Disclaimers
To the maximum extent permitted by applicable law, website and application content is provided for general
informational purposes and without warranties regarding completeness, accuracy, availability, or suitability for a
particular purpose.
Nothing in these Terms eliminates warranties or obligations that cannot lawfully be excluded.
Project-specific warranties are governed by the applicable construction agreement and warranty documents.
18. Limitation of Liability
To the maximum extent permitted by applicable law, TCS shall not be liable for indirect, incidental, special,
exemplary, or consequential damages arising solely from use of the website, applications, or digital services.
This provision does not waive or limit liability that cannot legally be waived or limited.
Nothing in these Terms modifies any liability provisions contained in a signed project-specific construction
agreement unless that agreement expressly provides otherwise.
19. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold TCS and its officers, employees,
agents, and representatives harmless from claims, losses, liabilities, damages, and expenses arising from your
unlawful use of the website or applications, fraudulent submissions, unauthorized access, or violation of these
Terms.
This provision does not replace project-specific indemnification provisions contained in a construction agreement.
20. Termination of Digital Access
TCS may suspend or terminate access to a website, application, customer portal, or digital account if reasonably
necessary to protect the Company's systems, comply with law, address misuse, or enforce these Terms.
Termination of digital access does not automatically terminate an existing construction contract.

21. Governing Law
These Terms shall be governed by applicable law of the State of Georgia, without regard to conflict-of-law
principles, except to the extent applicable law requires otherwise.
22. Changes to These Terms
TCS may update these Terms from time to time.
The updated version will become effective when posted or otherwise communicated, unless a different effective
date is stated.
Changes to an existing signed construction agreement must be made in accordance with that agreement and
applicable law.
23. Severability
If any provision of these Terms is determined to be unenforceable, the remaining provisions shall remain in effect
to the extent permitted by law.
24. Entire Agreement
These Terms govern use of the Company's websites and applications.
They do not replace a signed construction agreement or other project-specific written agreement.
The applicable project documents constitute the agreement governing the particular construction project.
